Auditing for Fair Lending Compliance

An effective fair lending audit can serve as an early warning mechanism to inform bank management of any apparent weakness within the bank’s fair lending program.  Ideally, it would confirm that the bank is following sound and equitable fair lending practices.  Regardless of the outcome, tackling a fair lending audit for the first time can be a daunting task at best.

With the current industry concerns about subprime mortgage lending, risk-based pricing, and general underwriting concerns, performing a fair lending audit of your bank’s lending program becomes even more warranted.

This full day auditing seminar will provide vital regulatory background information, as well as involve a thorough discussion of the Interagency Fair Lending Examination Procedures.  These procedures were originally published in January 1999, revised in 2004, and revised again last year.  This seminar will be based on the 2009 procedures, to assure that your fair lending review work meets current standards.  In addition, the seminar manual will be tailored to provide useful fair lending audit checklists when back at the bank.

The seminar will include discussions of the various types of discrimination and will progress through the process of performing a fair lending audit.

Seminar Topics

  • Introduction to the risk-based fair lending examination
  • Fair lending regulatory background
  • Overview of associated discriminatory practices
  • Setting the scope of a fair lending audit
    • Determining the intensity of the audit
    • Understanding credit operations
    • Evaluating the potential for discriminatory conduct
  • Performing a compliance management review
  • Fair lending audit procedures
    • Transactional underwriting analysis
    • Analyzing for potential disparate treatment in terms and conditions
    • Other fair lending examination review procedures
  • Case studies

Who Should Attend
This seminar is primarily designed for internal auditors and compliance officers.  However, other bank loan staff may also find the seminar informative from a practical approach.

Although developed to apply theory as opposed to mathematical skills, it is recommended that students bring along a calculator to assist with basic computations during the case studies.
